Maley was dismissed for poor attendance. He claimed unfair dismissal and later tried to include a claim for disability discrimination, relying on the employer’s failure to make reasonable adjustments. The EAT had to decide if this was an occasion when a grievance did not need to be lodged prior to bringing a claim.
