Cheltenham Borough Council v Laird
Job offers are often conditional upon completion of a satisfactory medical. Laird had a history of depressive illness. When she was interviewed for the role, she was on anti-depressants but not actually depressed. She did not disclose her history of depression on the council’s medical questionnaire and was appointed. When the parties fell out, the council claimed damages and argued that Laird had deliberately concealed her medical history.
