The repeal of the statutory dispute procedures and the publication of the new Acas code of practice has resulted in an increase in calls to the CIPD’s employment law helpline. Here are some of the most frequently asked questions. Does the new code apply to all levels of disciplinary action or just to dismissals?The new code deals with all levels of action related to conduct or performance, from written warnings to dismissals. Employers have become used to focusing on the correct procedures for dismissals, but failure to follow the code at an earlier stage, such as when a written warning is issued, could result in an adjustment of an award at subsequent tribunal proceedings.
