Under Tupe, consultation is required with employee representatives where measures are envisaged that may have an impact on employees “affected” by the transfer. In this case, two councils set up a joint venture with IBM to take over some support services. Following an “exemplary” consultation with Unison, a last-minute amendment in relation to future recruitment was agreed without consultation.
