This case highlights the fact that the unreasonable treatment of a disabled employee is not necessarily discriminatory. It is also a rare example of where a tribunal has ordered the reinstatement of someone who has been unfairly dismissed. It’s not usually practicable to reinstate dismissed employees where there has been a breakdown of trust and confidence, which is why it is such an uncommon remedy.
