Tupe protects any collectively agreed terms incorporated into employment contracts at the time of the transfer. But where a group of public-sector employees is outsourced to a private-sector employer, this does not bring to an end the collective bargaining process, so new employers have found themselves with new terms agreed after the transfer through collective bargaining.
