Tupe protects transferring employees from detrimental change, so employees can enforce their contracts of employment against the new employer. Tupe also commits the new employer to any collectively agreed terms incorporated into the contract at the time of the transfer. But what happens where agreement on collectively negotiated terms is reached after the transfer?
