Arhin v Enfield Primary Care Trust

Arhin was made redundant following a reorganisation that resulted in four consultant posts being reduced to two. The tribunal found that Arhin should have been included in the selection pool for appointment to the two remaining consultant positions but, although this had not happened, it accepted the Trust’s explanation that this was purely an error and had nothing to do with Arhin’s race. While the error made the dismissal unfair, Arhin’s direct race discrimination claim failed.
