Rutherford v Seymour Pierce Ltd
Rutherford was summarily dismissed before the final payment of that year’s discretionary bonus scheme was due. His compromise agreement did not cover his potential bonus entitlement, and he brought proceedings in the High Court. The employer argued that a term should be implied saying that bonus entitlements depended on employment continuing at the time of payment.
