BP plc v Elstone and another
For a whistleblowing claim to succeed, workers have to show they have made a protected disclosure and have suffered detrimental treatment as a result. Elstone worked for Petrotechnics, a safety company. BP was one of its clients. He was dismissed for gross misconduct when he made a series of protected disclosures to two senior BP employees about safety issues. BP subsequently engaged him as a consultant.
