For a claim of constructive dismissal to succeed, the conduct that has been complained about must be likely to destroy or seriously damage the relationship of trust and confidence between the employer and the employee. In this case, the EAT emphasised that the test for this is an objective one; neither the subjective perception of the employee, or the subconscious intent of the employer, is relevant.
