Deciding which overseas workers have dismissal protection in the UK

Sending employees to work abroad raises many legal issues – not least the question of whether these individuals retain the right to claim unfair dismissal in the UK. This is rarely straightforward, since the employee or the employment relationship may come under different jurisdictions at different times. The problem has been with us since the 1970s and appears to be not much closer to a solution. But there are some lessons from case law.
