Although this was a case brought under the Disability Discrimination Act 1995, the principles involved will continue to apply under the Equality Act 2010.Wakefield damaged the tendons in her right arm in a workplace accident that restricted her ability to perform some of her job functions, such as using a computer. After some delay, the employer arranged a workplace and occupational health assessment. Recommendations were made following both assessments: the first were implemented, but found not fit for purpose; the second set of recommendations was not implemented.
