Fulcrum Pharma (Europe) Ltd v Bonassera and HR Advantage Ltd
This case emphasises the importance of employers giving careful consideration to a redundancy process. Where there is a possibility of bringing subordinate employees into the selection pool for redundancy, the employer is responsible for raising the prospect of considering a more junior role at a reduced salary with the more senior employee. The employer has to be proactive; the possibility cannot be ignored simply because the employee does not suggest it.
