There can be two types of transfer under The Transfer of Undertakings (Protection of Employment) Regulations 2006 (Tupe):(i) a ‘standard’ transfer of an economic entity which retains its identity; or(ii) a ‘service provision change’, where the activities previously carried out by an organisation are assigned to a contractor, or are switched from one contractor to another, or are brought back in-house, and the activities are essentially the same pre- and post-transfer.
